Terms and Conditions

The following Terms and Conditions will apply to your booking and occupancy at Waddy Lodge.

1.         Interpretation

For the purpose of these Terms and Conditions:

“Waddy Lodge” and “the Premises” means the grounds and buildings of Waddy Lodge. 

“the Property” means the particular house and/or unit/s at Waddy Lodge that is/are booked by you.

“you” means the person nominated on the booking request as completing the booking

“your party” means any person listed on the booking information as occupying the Premises

“visitor/s” means any other person/s invited or allowed onto the Premises by you or your party.

“guest/s” means any or all of you, your party, and visitors

“we” means Waddy Pty Ltd

2.         Booking Confirmation Notice

These matters set out in a booking confirmation notice shall form part of these Terms and Conditions.

3.         Booking Conditions

The Booking Conditions and House Rules form part of these Terms and Conditions

4.         Understanding and Observance of Terms and Conditions

By lodging a booking request and paying a deposit, you are agreeing to these Terms and Conditions on behalf of yourself, your party, and your visitors.

We reserve the right to change all or part of these Terms and Conditions at any time.

You must monitor the observance of the Terms and Conditions by your party and visitors. A breach of these Terms and Conditions by any member of your party or visitors will be considered a breach by you.

5.         Occupancy and Eviction

a) Guests are granted a limited permission to occupy the Property for holiday purposes on the Terms and Conditions set out herein

b) This is not a residential tenancy agreement under residential tenancy legislation

c) Failure to comply with the Guest's obligations in the Terms and Conditions may result in (but is not limited to)

i.          termination of permission to occupy the Property and eviction;

ii.        loss of rental paid; and

iv.        any extra charges for any loss incurred by Waddy Pty Ltd as a result of the failure to comply

6.         Number of Guests

The number of Guests occupying the Property overnight must not exceed the number of Guests set out in the booking without the approval of the Managers.

Under no circumstances may the number of Guests occupying the Property overnight exceed the maximum stated occupancy of the Property.

7.         Visitors

Reasonable numbers of Visitors are welcome during reasonable hours, provided that in the sole discretion of the Managers the number of visitors and behavior of visitors does not adversely impact the enjoyment of the Premises by others.

8.         Damage to Premises

If on arrival you notice any existing damage within the Premises you must report such to the Manager within 24 hours after arrival. Otherwise it is agreed that all is in order with the Premises.

You will be liable to pay for the repair of any damage caused by you or your party during your occupancy.  This includes but is not limited to damage to or loss of buildings, appliances, furnishings, fittings, kitchenware or any other thing provided as part of the Premises.  Your liability will not apply to reasonable wear and tear.

9.         General obligations of Guests and Visitors

Guests and Visitors must:

a) Not use the Premises for any unlawful purpose.

b) Comply with all House Rules

c) Respect the residential amenity and security of the Property and the Premises and refrain from anti-social behaviour;

d) Comply with any instructions from the Manager during their stay; and

e) Notify the Manager of any disputes or complaints as soon as is practicable.

10.       Access

Waddy Pty Ltd reserves the right to enter the Premises at any time for any reason to ensure the compliance with these Terms and Conditions.

13.       Limitation of Liability

In no event shall Waddy Pty Ltd or their officers, employees or agents be liable to any Guest or Visitor for any loss or injury or any damages, either direct, indirect, punitive, special, incidental, consequential or otherwise resulting from or in any way connected to the Guest’s booking or occupancy of Waddy Lodge, even if the Guest has been advised of the possibility of such damages.

14.       Jurisdiction for Disputes

Any disputes are to be determined by the Courts having jurisdiction in Queensland in accordance with the laws of Queensland.
